Procedural question, Brazilian FOP cases

we met again on a recently uploaded file out of a batch processed by you where I wrote a COM:FOP Brazil DR. I think that it wasn't the last time that this has occurred. So, what do you think as better, or what would you prefer? I can stick to classic DR, when I already have made a crop (or refrained from doing so), but that entails a long string of automatisms and page creations which could be seen as hassle; Pro: a tracking through the categories in Category: Brazilian FOP cases is available. On the other hand, I could also write you here, on the talk page, to discuss stuff (like FOP induced RevDels). No one should be compelled to use a DR when an uploader and a reviewer could cooperate in doing some clean up after a batch; Pro: less hassle, less pages created, Con: no category-based tracking. - @Grand-Duc Hi, thank you very much for your message and proposal. I also don't think there's a need for DRs about this stuff either, as I often crop the images myself when I notice there are issues with FOP. I would be very glad if you care to notify me here about any upload that needs to be fixed by a crop or other means (or even be deleted, if it's unfixable). Dúvida
[edit]Olá Darwin, como vai?
Não sei se pode me ajudar, mas estou desde ontem com esta dúvida que levantei no Ws en e no Commons: eu gostaria de adicionar aqui e no Source algumas obras do Governo Brasileiro que foram publicadas lá na década de 40 e 60 (como esse multilingue com discursos do Vargas), que, pelo que entendo, entraram em domínio público no Brasil segundo o Art. 662 do Código Civil de 1916 (com o Art. 46 valendo para a lei de 1973).
Acho que não existiriam dúvidas que estas obras estariam em domínio público no Brasil (apesar da Biblioteca da Presidência bancar a lei de 1998 pra banir certos usos de obras de décadas antes), mas eu gostaria de saber: também estariam liberadas nos EUA? Minha impressão é que elas se encaixariam bem dentro do PD-1996, com a versão em português do PD-Brasil-Gov podendo ser expandida para considerar as leis de 1916 e 1973 (a versão em inglês está bem completa). - @Erick Soares3 Olá Erick, tudo que seja anterior a 1983 está coberto pela PD-Brasil-Gov e não é afectado em nada pela URAA, que só cobre o que não era domínio público nessa data, de modo que pode carregar à vontade. A lei actual não se aplica a esses conteúdos, que estão em domínio público há décadas, independentemente dessas alegações que falou. Darwin Ahoy! 00:32, 2 April 2025 (UTC)
- Entendido! Então vou começar amanhã, considerando que essa Biblioteca tem muito conteúdo relevante para o Commons (se essa história de bot pra mass upload não fosse tão complicada, até pediria um envio geral, como essa coleção também merece)! Eu também achei essa revista do governo brasileiro (mas publicada em inglês nos EUA) com muito conteúdo relevante e não encontrei nenhuma marca de copyright (ou evidência delas terem sido registradas posteriormente). Aqui seria aceitável como PD-US-non registered? O Google Books liberou o acesso/download de todas, de forma que imagino que não tenha proteção nos dois países (ao contrário desta bio do Machado de Assis, que não teve seu copyright renovado, mas só o HathiTrust libera a visualização). - @Erick Soares3 Eu tenho um botzinho em React (Catrapilha) que é o que estou usando para uppar a feed da Prefeitura de PoA, mas a minha impressão é que se estiver a fazer a curadoria junto com os carregamentos (o que é recomendável, para evitar problemas) o ganho não é tão grande assim, a menos que os metadados estejam bem organizados na fonte e sejam fáceis de traduzir para categorias do Commons. Em relação à revista, o que diz parece ser aplicável a essa situação, e penso que deve ser suficiente, mas caso tenha dúvidas pode sempre colocar o caso na esplanada de copyright. - No caso da Biblioteca da Presidência, acho que deverá ser necessário fazer uma curadoria, enquanto a coleção do HathiTrust já está como PD-USGov. Eu cheguei a levantar essas questões na Esplanada, mas só tive resposta no Wikisource e agora com você - e também concordo que esse PD/sem registro é o bastante pra revista (também seria PD no Brasil, como obra do governo).
- Essas leis de copyright acabam sendo bem chatas ou vagas. Até hoje não entendi bem o que "ato oficial" da lei de 98 (art. 8) abrange -- se é apenas leis, ou outras obras como o relatório do VLS-1 ou imagens publicadas por entidades do governo também entram nesse artigo (apesar de hoje em dia o governo usar um creative commons não comercial). Image EXIF data
[edit]Hi, you imported File:Kids (61221640).jpeg from 500px some years ago, but the EXIF data of the image says "all rights reserved". Is that ok? Nakonana (talk) 17:43, 6 April 2025 (UTC)
- @Nakonana Yes, as it was published by the author in 500px with an open license (CC-BY-SA 3). It is very common that the EXIF information contradicts the license, usually because that's the default info the person has set in the camera, and they are not changing it for some specific file they release under a free license. There's not any reason to give any special value to it, as long as the file was freely relicensed by the same author. Darwin Ahoy! 18:10, 6 April 2025 (UTC)

- @JayCubby Hello! I really can't explain that. It was deleted in August 2022 as part of an automated batch of uploads of a Brazilian vandal, who has no relation with this image. It's really a mystery. I'm very glad you noticed that, and I've restored the image. I checked the log of that batch, and there seem to be no other unrelated eliminations. Really weird.
